1. Services Provided

VIP Tech Assist LLC provides in-home and remote technology support, including setup, troubleshooting, security hardening, backup configuration, device transitions, parental controls, and continuity and legacy planning for personal accounts and devices. Services are described in detail, including current pricing, at vipTechAssist.com/services-and-pricing. Services are billed as flat-fee projects rather than by the hour. Where a project requires work beyond its defined scope, I'll discuss any additional cost with you before proceeding, rather than billing an open-ended hourly rate.

2. Eligibility

You must be at least 18 years old and have the legal authority to contract on your own behalf, or on behalf of your household, to engage my services. Where a service involves a household member who is a minor, such as Parental Controls, that work is performed only with the express authorization of the parent or legal guardian who has engaged my services, as described further in Section 6.

3. Pricing and Payment

Current project pricing is published at vipTechAssist.com/services-and-pricing and is subject to change. Payment is processed securely through Stripe. A deposit is required to confirm a booking, with the remaining balance due upon completion of the service. All payments are in US dollars. I'll notify you before any additional work beyond an agreed project's defined scope, so you're never billed for something you didn't agree to in advance.

4. Cancellation and Rescheduling

I understand plans change. Cancel or reschedule at least 48 hours before your scheduled appointment for a full refund of your deposit or to rebook at no penalty. Cancellations made within 48 hours of the appointment are not eligible for a deposit refund, though I'll always try to work with you to find another time.

5. Remote Support

Some services include or offer remote troubleshooting using Splashtop, an attended-access tool. Remote sessions only begin with you present and after you actively approve the connection, and end the moment you close the session window. I do not have standing or background access to your devices. Full detail on how this works is provided in a separate Remote Support Consent document before we ever use this tool together.

6. Parental Controls and Household Minors

Parental Controls is a service purchased and authorized by a parent or legal guardian. Providing it requires accessing and configuring a minor's device logins, gaming and social media accounts, screen-time settings, and, where the family opts in, location-sharing features. By purchasing this service, you represent that you are the parent or legal guardian of the child or children whose devices and accounts will be configured, and that you have the authority to consent to this on their behalf. This information is used solely to deliver the requested service and is handled according to the Privacy Policy at vipTechAssist.com/privacy-policy.

7. Data, Backups, and Your Responsibilities

Where I provide backup services, I configure, test, and instruct you on a backup solution covering your devices, as described in that service's scope. I take reasonable care in setting up and verifying these systems, but I am not the custodian of your data on an ongoing basis. You remain responsible for maintaining your backup accounts and storage after setup, unless you're enrolled in an ongoing maintenance or membership service that explicitly includes recurring backup verification.

8. Confidentiality and Privacy

I treat what I see and handle in your home, on your devices, and in your accounts as confidential. Full detail on what information I collect, how it's used, and who I share it with is in the Privacy Policy at vipTechAssist.com/privacy-policy, which is incorporated into these terms by reference. For clients requesting a formal confidentiality agreement, an NDA is available on request.

9. HIPAA and Regulated Data

I've completed HIPAA privacy and security training and apply that knowledge to how I handle your devices, accounts, and data. VIP Tech Assist LLC is not a HIPAA-covered entity or business associate, and these Services are not a HIPAA-compliant environment for storing, transmitting, or processing protected health information on your behalf. If your device or account setup touches health information, I bring the same care to it as to everything else I handle, but you should not rely on this engagement as a substitute for HIPAA-compliant handling of that information where such compliance is legally required.

10. Third-Party Tools and Services

Delivering these services sometimes involves setting up or recommending third-party tools and services, including password managers, backup providers, VPN software, and remote access software. Each of these is provided by its own company under its own terms and privacy practices, which I encourage you to review. I'm not responsible for the ongoing performance, security, or policies of a third-party product once it's outside the scope of the project I was engaged to complete, though I stand behind the setup and configuration work itself.

11. Website Content and Intellectual Property

The text, design, and content of vipTechAssist.com belong to VIP Tech Assist LLC and are provided for your personal reference. You may view and print pages for your own use. You may not copy, republish, or use site content for commercial purposes without written permission. Contact Help@vipTechAssist.com for any such request.

12. Disclaimer

Services are provided on an as-is, as-available basis, and I make reasonable efforts to perform them skillfully and professionally. I don't warrant that every issue will be permanently resolved, that recommended third-party software or hardware will perform without fault, or that the website will be free of errors or interruptions. To the fullest extent permitted by law, I disclaim implied warranties of merchantability and fitness for a particular purpose beyond what's expressly promised for a given project's scope.

13. Limitation of Liability

To the fullest extent permitted by law, VIP Tech Assist LLC's total liability to you for any claim arising from these services, whether based in contract, tort, or any other legal theory, is limited to the amount you paid for the specific project or service giving rise to the claim. In no event will VIP Tech Assist LLC be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, or loss of use, even if advised of the possibility of such damages. Nothing here limits liability that cannot be limited under applicable law.

14. Indemnification

You agree to hold VIP Tech Assist LLC harmless from claims arising out of your breach of these terms, your violation of applicable law, or inaccurate information you provide that affects the service delivered.

15. Term and Termination

These terms remain in effect for the duration of our working relationship. Either of us may end an engagement at any time; fees for work already performed remain due.

16. Governing Law and Dispute Resolution

These terms are governed by the laws of the State of Georgia. If a dispute arises, we agree to first attempt to resolve it informally for at least 30 days. If that doesn't resolve it, either of us may bring the dispute in Magistrate Court (small claims) in the Georgia county where the service was performed or where VIP Tech Assist LLC is located, for any claim within that court's jurisdictional limit. For a claim exceeding that limit, the dispute will instead be resolved through binding arbitration administered by the American Arbitration Association, conducted in Atlanta, Georgia, on an individual basis only, not as a class, collective, or representative action. Either of us may seek injunctive relief in court where necessary to protect intellectual property or confidential information.

17. Electronic Communications and SMS

By providing your phone number, you agree to receive appointment-related texts and calls from VIP Tech Assist. Reply STOP to any text to opt out of SMS communications. Message and data rates may apply based on your carrier.

18. California Residents

If a complaint with VIP Tech Assist LLC is not resolved to your satisfaction, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at (800) 952-5210 or (916) 445-1254.

19. Changes to These Terms

I may update these terms from time to time. The "Last updated" date at the top will reflect the most recent revision. Continued use of my services after a change means you accept the updated terms.
